It looks like the black on the tail lights is on the inside of the lens cover so you should be good to just polish the lens like you would do a headlight that had yellowed. Mask off the paint of when your rubbing out the scratches you have a good chance of fucking up the paint especially if it was a real cheap quick and dirty paint job....
